Welcome to Âire. These Terms of Service ("Terms") govern your use of our website and your purchase of Âire products (the "Services"), operated by Âire ("we," "us," or "our"). By visiting our site or purchasing from us, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

By using the Services, you represent that you are at least 18 years of age, or that you are at least the age of majority in your state of residence and have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose.

2. Products and health disclaimer

Âire mints are an oral wellness product formulated with prebiotic and postbiotic ingredients to support fresh breath and a balanced oral microbiome. Our products are intended to support normal, healthy function only.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Our products are not a substitute for professional dental or medical care. Consult your dentist, physician, or other qualified health provider with any questions about a medical or dental condition, or before use if you are pregnant, nursing, or taking medication. Review the ingredient list before use if you have known allergies. Keep out of reach of small children and pets; xylitol is toxic to dogs.

3. Orders, pricing, and payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse or cancel any order, including orders that appear to be placed by resellers or bots, or where a pricing or listing error occurred; if we cancel an order after you have been charged, we will refund you in full. You agree to provide current, complete, and accurate purchase and account information for all orders. Payment is collected at checkout by our payment processors; we do not store your full card details.

4. Subscriptions (Subscribe & Save)

If you purchase a subscription, you authorize us to charge your payment method on a recurring basis at the frequency you select at checkout, at the subscription price shown, until you cancel.

• Automatic renewal. Your subscription renews automatically. Each renewal charge occurs when the renewal order is placed, using the payment method on file.
• Cancel anytime. You can pause, skip, or cancel at any time with no fee, either through your account page or by emailing hello@airemints.com. Cancellations take effect immediately for any renewal that has not yet been processed.
• Price changes. If the subscription price changes, we will notify you by email before the change applies to your renewals.
• Refunds. Each subscription shipment is covered by our 30-day money-back guarantee, described in our Refund Policy.

5. Shipping

We currently ship within the United States. Delivery estimates shown at checkout are estimates, not guarantees. Risk of loss passes to you upon our delivery of the order to the carrier, but if an order is lost or arrives damaged, contact us and we will make it right as described in our Refund Policy.

7. Intellectual property

The Services and all content on this site — including text, graphics, logos, images, product formulations, and software — are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Services without our express written permission.

8. Acceptable use

You agree not to use the Services to violate any law or regulation, infringe the rights of others, transmit malicious code, scrape or harvest data, or interfere with the operation or security of the site. We may terminate your access to the Services for violating these Terms.

The Services may include links to third-party websites or make third-party tools available. We are not responsible for third-party content, websites, or tools, and your use of them is at your own risk and subject to their terms.

10. Disclaimer of warranties

Except for the express guarantee in our Refund Policy, the Services and all products are provided "as is" and "as available" without any warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some states do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, in no event shall Âire, its directors, employees, or suppliers be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products, and in no event shall our total liability exceed the amount you paid us for the product giving rise to the claim. Some states do not allow the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be waived.

12. Indemnification

You agree to indemnify and hold harmless Âire and its affiliates, officers, and employees from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

13. Severability and waiver

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the fullest extent permitted and the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Changes take effect when posted; your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

15. Governing law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. If you are a consumer, you may also benefit from mandatory consumer protection provisions of the law of the state where you reside.
